Penali Spotify sul mio account - frode

Ho ricevuto questa mail da iMusician:
“Spotify ci ha segnalato attività di streaming sospette nel tuo catalogo. Di conseguenza, Spotify applica una penale di 10 € per ogni brano oppure annulla completamente tutti i ricavi delle tracce coinvolte. Tali ascolti fraudolenti non verranno contabilizzati.”
Credo che ci sia un errore, una frode o che mi abbiano clonato l’account. Vorrei parlare con il team di iMusician per avere ulteriori informazioni e verificare questa cosa. Io ho un solo disco caricato su Spotify tramite iMusician e per di più con pochissimi ascolti, non ci guadagno nulla, né spingo per aumentare gli ascolti. Quindi c’è sicuramente qualche cosa che non va. Per favore, datemi la possibilità di comunicare con il team. Grazie

And right now I saw on my I have -19.74€…this doesn’t make any sense, 'cause normaly I don’t earn nothing from my one and only release I have with iMusician, so it’s insane that I have to lose money…
Please, if anybody can help me…it’s also frustrating that I can not talk with any physical person because my release is old and when I made it it was possible to email and speak with somebody.

After a closer look, here are the informations we have at our disposal regarding the penalties that Spotify applied to your sales :

  • Track affected: Blackbird
  • Period affected: May 2025
  • Penalties total: 10€

You will see -9.95€ in June 2025, but that’s an error from our end which we have now corrected. Sorry about that!

Unfortunately, the penalties are applied by Spotify independtly from us and we don’t have access to more details than what I’ve provided above. Please read this article for more inforation on this topic: Why am I seeing Spotify Fraud Fees in my sales report? | iMusician

how can I get more details about who defrauded me?
I did not add the track to any playlist nor did I repeatedly play that track, so how can I find out who did it and get my money back?
Could you report this fraud to Spotify on my behalf?
Also, since the distributor of the track is iMusician, I should be protected through iMusician.
I have also read that other clients of yours have experienced the same issue. Would it be possible to resolve this by sending a single communication to Spotify that is valid for all affected users?

Unfortunately, this is not an information we have access to. As I told you, Spotify provided the details I already shared with you. I’m afraid we can’t assist you with this.

I’m not sure how you are coming to this conclusion but this is not part of our agreement. As a distributor we only provide the services outlined by the terms of service you’ve agreed to when you created your account. Our terms of service clearly state that the content policy of each shop or territory is beyond our control.

I understand that Spotify’s decision to apply such penalties comes as a disappointment to you, but this decision is independent from us.

This debt will be paid back with your future sales revenue or we can invoice you the amount to balance it out straight away. As you prefer.

Just to clarify: I contacted Spotify and they advised me to reach out to iMusician, which is why I’m following up again (I am also attaching at the end of this email the JPG of my conversation with Spotify support, which unfortunately seems to have been with a chatbot.). I believe that only you, as the distributor, have the authority to notify Spotify about this kind of fraudulent activity and to confirm that your clients are honest and not involved in any wrongdoing.

Additionally, I earn practically nothing from Spotify, as you can see from my profile, so it is truly absurd, frustrating, and unfair that I should be required to pay for something I did not cause.

Even though the amount requested is small and it would be easier for me to simply pay it and move on, this still feels like a real injustice.

So I would like to ask once again: is it really impossible for iMusician to communicate this issue to Spotify? I have seen from your blog that this has also happened to other artists. My request is not necessarily to resolve the issue immediately, but at least to make Spotify aware of the problem so that they can take action and prevent this from happening again in the future.

I completely understand your approach, but I’m afraid this doesn’t change the situation. The only reason why Spotify is redirecting you to the distributor is because they refuse to communicate directly with the artists. However, the distributor doesn’t have any authority over the platform’s T&Cs, which include their penalty policies.

I understand that there is nothing that can be done, even though I am a victim of this Spotify boosting, and I do not know who carried it out.

Therefore, I would like to pay the requested amount. Could you please deduct it directly from my available credit?

In addition, I would like to remove my release from iMusician and close my account. Could you please let me know how I should proceed?

Hey @Sabrina,

Currently, your cash credit balance is negative - because of the Spotify penalties - therefore it’s not possible to use it. I’ve added an invoice to your dashboard so you can even it out and pay the remaining 4,59€.
